CARE AFTER PLANTING: The first year following planting is the most critical in respect to plant survival. Because of different environmental conditions, we will advise you as to proper care of plant material.

OUR GUARANTEE: Nursery stock sold by, but not planted by Rutgers Nursery and Landscape, INC. is guaranteed for 90 days and you must have your receipt. Plants will not be guaranteed against animal damage or any other cause over which we have no control. We guarantee our nursery stock to be true to name and currently inspected by the New Jersey Department of Agriculture.

Nursery stock planted by Rutgers Nursery and Landscape, Inc. is guaranteed for 1 year on all plants including delivery and labor for up to 2 visits, in the appropriate spring and/or fall seasons. All replacements will be done in the 3rd week of April, the 3rd week in May, and the 1st week in October. NO EXCEPTIONS. WE DO NOT WARRANTY ANY TRANSPLANTED PLANTS FROM THE CUSTOMER’S SITE.

ALL PLANT WARRANTIES WILL BE HONORED PROVIDED THAT all plantings are cared for in accordance with care and maintenance instructions and all charges involved are paid in full. Rutgers Nursery and Landscape, Inc. is also not responsible for loss due to very unusual or excessive wind, freezing, hail, snow, moisture, dryness, insects, and diseases or any cause over which we have no control. Plants needing replacement will be replaced one time only, and at a time that is consistent with good planting practices.

All contracted brick/paver work or stone wall work will be marked out prior to installation. Marking paint will indicate where the work will be performed. Customers will be contacted and requested to review and approve the mark-out prior to the work being performed. All contracted brick/paver work or stone wall work will be installed within the marked out areas. There will be ADDITIONAL CHARGES FOR ANY REQUESTS TO RELOCATE/MOVE THE BRICK/PAVER OR STONE WALL WORK AFTER THE INSTALLATION HAS BEEN PERFORMED. Please understand that this work is 95% preparation and it is very costly to move/relocate this type of work. Therefore, we mark out in advance to satisfy everyone. All brick/paver work and/or wall work is guaranteed for 2 years against settling and shifting.

All contracted work by Rutgers Nursery must be paid in full prior to the scheduled work date. In the event of a job cancellation by the customer, it is agreed there will be a handling/ordering fee imposed of 20% of the total material charges on your contract. 20% of the cost of the material will not be refunded.

Rutgers Nursery also provides tree-staking services for a fee. If the plant material is going to be planted in a high wind area, it is the customer’s responsibility to request a quote for the staking of all trees. If the plant material begins to lean after the time of planting and staking is required, there will be a service charge of $40.00 plus $8.00 per stake installed for the staking of the plant material.

Charges for any additional material or labor ordered by you will be added to the original order.

RUTGERS LANDSCAPE ADDITIONAL TERMS & CONDITIONS: A 1/3 down payment is due upon signing of the contract with Rutgers Landscape. Another 1/3 down payment is due before the job is started. The remaining 1/3 is to be paid in full upon completion of work, unless other arrangements have been made. Overdue invoices will be charged a 1.5% per month service fee (annual rate of 18%), plus cost of collection, if any. This estimate is subject to revision after 30 days as the availability of many materials is not constant. WORK WILL NOT BEGIN UNTIL THE SECOND DEPOSIT HAS BEEN RECEIVED BY RUTGERS LANDSCAPE, INC.

We cannot be financially responsible for underground utilities and other obstructions if we do not know about them in advance. If damage occurs, it will be the customer’s responsibility to pay for the repair. This includes sprinklers, underground irrigation, lighting systems, and any other underground damage.

FOR YOUR PROTECTION: We are a professional company, subscribing to the standards of the New Jersey Nursery and Landscape Association (N.J.N.L.A.) and the American Association of Nurserymen (A.A.N.). We carry all applicable insurances and we are licensed by the New Jersey Department of Agriculture.
